Abstract

Since his Creation , man needs food , dwellings and other needs to sustion life. Therefore , there has been mutual relation among members of society developed through , historical stages till taking the current form . In order to prevent disputes among individuals while dealing with each other , the current study is focusing on price difference and its impact on selling contract , as one of the main reasons for such disputes. . The study consists of an introduction , two sections and a conclusion Reasons for selecting this topic is dealt with in the introduction . Section one deals with the meanings of difference , selling and price Section two is focusing on impact of difference in case there is an evidence or not and in case price is spoilt . It also deals with contract in case the two parts differ. احتاج الإنسان ومنذ خلقه إلى المأكل والمشرب وغيرهما من الحاجات ولتأمين هذه الاحتياجات وجدت علاقة تبادلية بين أفراد المجتمع تطورت عبر مراحل تاريخية حتى صارت في صورة المعاملات الرائجة الان ، ولمنع حدوث النزاعات بين أفراد المجتمع أثناء تعاملهم لسد احتياجاتهم ـ والتي قد يكون الاختلاف في الثمن أحد أسبابها ـ جاء هذا البحث ليسلط الضوء على الاختلاف في الثمن وأثره في عقد البيع
لقد تضمن البحث مقدمة ومطلبين وخاتمة .
المقدمة تضمنت تمهيدا للبحث وسبب اختيار هذا الموضوع .
المطلب الأول : وفيه ثلاثة مقاصــــــد خصصت لبيان معنى الاختلاف والبيع والثمن لغة واصطلاحا .
المطلب الثاني : وفيه ثلاثة مقاصد أيضا .
المقصد الأول : أثر الاختلاف في الثمن عند وجود البينة أو عدمها .
المقصد الثاني : أثر الاختلاف إذا تلف الثمن .
المقصد الثالث : حكم العقد إذا اختلف المتبايعان بعد تلف الثمن .
الخاتمة . وتضمنت أهم النتائج والتوصيات .
